Hukumat Se Jhut Bol Kar Maali Madad Hasil Karna


 Sawal 

Kya maali madad (financial help) hasil karne ke liye hukumat se jhut bola ja sakta hai ya unhe dhoka diya ja sakta hai agar hukumat kafir ki ho, kyuki ham hukumat ko Taxes bhi dete hai.

 Jawab 

Alhamdulillah..

Jhut bolna ya dhoka dena ek Musalman ki sifat nahi hai, aur ye aur khatarnaak ho jata hai jab ap maali madad ke liye aesa karte hai kyuki fir usme haraam kamayi shamil ho jati hai.

Aur isse koi farq nahi padta, ki jisse ap jhut bol rahe hai wo Musalman hai ya kafir, wo ek shaks hai ya hukumat, jhut aur dhoka har haal me galat hai.

۩ Abdullah bin Masud r.a. riwayat karte hai ki RasoolAllah ﷺ ne farmaya, “Sach neki hai aur neki Jannat ki taraf le jati hai aur bandah puri koshish se sach bolta rahta hai hatta ke wo Allah taa'la ke nazdeek Siddiq (sachha) likh diya jata hai aur jhuth fahaashi hai aur fahaashi jahannam ki taraf le jati hai aur bandah jhuth bolta rahta hai hatta ke use jhutha likh diya jata hai.”

Sahih Muslim, kiab al birr was silati wal adab ﴾45﴿, hadees- 6638.

۩ Abu Huraira r.a. riwayat karte hai ki RasoolAllah ﷺ ne farmaya tha, “Logo par ek aesa zamana ayega ki admi is baat ki parwah nahi karega ki wo halal tarike se kama raha hai ya haraam tarike se.”

Sahih al-Bukhari, kitab al buyu ﴾34﴿, hadees- 2059.

۩ Abu Huraira r.a. se riwayat hai ke unhone ne kaha RasoolAllah ﷺ ne farmaya,

“Aye logo Allah Paak hai aur paak (maal) ke siwa koi maal qubool nahi karta. Allah ne momino ko bhi isi baat ka hukm diya hai jiska Rasoolon ko hukam diya hai. Allah ne farmaya, "Aye paigambaraan e karaam! Paak cheezen khaao aur nek kaam karo. Jo amal tum karte ho mai usay achi tarah janne wala hu. Aur farmaaya Jo pak rizq hamne tumhe inayat farmaya hai us maise khaao.

Fir Aap ﷺ ne ek aadmi ka zikr kia "Jo taweel safar karta hai, Baal pur-agard aur jism ghubaar-alood hai wo ( dua ke liye) aasmaan ki taraf apne haath uthata hai, (aur kahta hai) "Aye mere Rab! Aye mere Rab". Jab ke iska khana haraam ka hai, iska peena haraam ka hai, iska libaas haraam ka hai aur isko ghizaa haraam ki mili hai, fir iski Dua kaise qubool ho sakti hai.”

Sahih Muslim, kitab al zakat ﴾12﴿, hadees - 1015.

Toh isi liye apke liye ye jayez nahi ki ap hukumat se jhut bol kar ya unhe dhoka dekar maali madad hasil kare.

Isi talluq se ek arabi muhawra kuch is tarha hai,

“Jab ap aese maal se hajj karo jo asal haraam ka hai, toh fir aapne toh hajj nahi kiya lekin aap ke oont ne hajj kar liya”

Qisto (installments) Par Samaan Lene Ke Ahkaam


Alhamdulillah..

Qisto me saamaan lene ka matlab ye hai ki ap saamaan ko pahle hi hasil kar le aur uski qeemat baad me ek hi baar me ya thoda thoda kar ke ada kare.

Qisto me len-den un masail me se hai jin ka is daur me hukm malum karne ka ahtimaam karna zaruri hai. Is liye ke dusri jung e azeem (2nd world war) ke baad qisto me muamla karna bahut aam hota ja raha hai.

Aaiye dekhte hai hamare Deen ne hame is bareme kya rahnumayi ki hai:

۩ Ayesha r.a. bayan karti hai ke Nabi ﷺ ne ek Yahudi se udhaar galla (food) khareeda aur us ke paas apni lohe ki dhaal girwi rakh di.

Sahih al Bukhari, kitab al buyu ﴾34﴿, hadees- 2068.

Yeh hadees qisto par udhaar saamaan khareedne aur bechne ki dalalat karti hai.

Agarche qist me khareed farokht ki daleel milti hai lekin is chiz me ulema e karaam me ikhtilaf hai ki kya qisto me saamaan ki qeemat se zyada paise dena ya lena jayz hai ya nahi yaani agar koi chiz 100 rupye ki hai toh qist me lene ke wajah se wo samaan ki qeemat 110 ho jaye, jo ki aam taur par hamare muashre me hota hai.

Bahut kam ulema is chiz ko haraam samajhte hai aur wo kahte hai ki yeh sood hai. Unka  ye kahna isliye hai kyuki is me qeemat zyada hai aur ye zyada qeemat, muddat (time-period) ke wajah se hai toh yahi sood kahlata hai .

Aur Jamhur (aksar) ulama e karaam jin me aimma arba (char imam) bhi shamil hai wo iske jawaaz (jayez hone) ke qayel hai.

۩ Hanafi mazhab me hai ke:

'Muddat ke aewaz qeemat badhana jayz hai.'

Badaa'i al-Sanaa'i, 5/187.

۩ Maliki mazhab:

'Zyada waqt ke liye qeemat me se kuch miqdaar badha kar rakhi ja sakta hai.'

Bidaayat al-Mujtahid, 2/108.

۩ Shafi mazhab:

'5 Nakad (cash), 6 taakheer ki adayegi ke barabar hai.'

al-Wajeez by al-Ghazaali, 1/85.

۩ Hambali mazhab:

'Deri keemat me kuch shamil kar deti hai.'

Fataawa Ibn Taymiyah, 29/499.

In ahle ilm ke dalail ye hai:

Allah ﷻ farmate hai,

۩ 'Allah ne tijarat ko halal kiya.'

Surah Baqarah ﴾2﴿, ayat-275.

Is ayat ka aam matlab me har tarah ki tijarat aati hai jisme taakhir adayegi ke tahat qeemat ko badhana bhi shamil hai.

۩ Aye logo jo eeman laye ho, aapas me ek dusre ke maal batil tareeqo se na khao, len-den hona chahiye aapas ki razamandi se.

Surah Nisa ﴾4﴿, ayat-29.

Is ayat ka aam matlab bhi isi taraf nishandehi karta hai ki ek dusre se tijarat karna jayz hai agar apas ki razamandi ho. Yaani agar khareedne wala shaks zyada keemat dene ko tayar hai taakhir ki adayegi ki wajah se toh len-den jayz hai.

۩ Jabir bin Abdullah r.a. riwayat karte hai ke maine Nabi ﷺ ko safar me ek oont (camel) becha tha. Jab ham Madinah pahunche toh Aap ﷺ ne farmaya ke masjid me ja kar do rakat namaz padh lo, fir Aap ne (oont ki keemat ko sone se) wazan kiya aur mujhe asal qeemat se zyada keemat ada ki.

Jabir r.a. mazeed kahte hai, 'Is me se kuch thoda sa mere paas tab se mahfooz tha. lekin shaam wale ( Yazeed ke lashkar) yaum e Harra ke mauqe par mujh se cheen kar le gaye.

Sahih al Bukhari, book of gifts ﴾51﴿, hadees- 2604.

۩ Shaykh ibn Baaz se muddat ke aewaz me qeemat zyada karne ke hukm ke mutalliq sawal kiya gaya toh unka ye jawab tha:

“Is muamla me koi harj nahi, is liye ke saamaan ke liye nakad ada karna aur taakhir me ada karne me farq hai, aur aj tak musalman is tarha ke muamlat karte aa rahe hai, is ke jayz hone par unki janib se yeh Ijma ki tarah hi hai, aur baaz ulema ne is par ajeeb raaye rakhi aur muddat ke aewaz qeemat zyada karne ko mana qaraar diya hai aur un ka gumaan hai ke yeh sood hai, is qawl ki koi bunyad nahi banti, aur na hi ye sood hai, is liye ke tijarat karne wale ne jab udhaar samaan farokht kiya toh woh muddat ki wajah qeemat zyada karke nafa haasil karne par muttafik hua aur kharidar bhi mohlat aur muddat ki bina par qeemat zyada dene par muttafik hua kyuki woh naqad qeemat ada karne ki istetaat nahi rakhta, toh is tarha dono fareeq is muamle se nafa haasil karte hai.

Nabi ﷺ se bhi is ka sabut milta hai jo is ke jayz hone par dalalat karta hai woh yeh ke Nabi ﷺ ne Abdullah bin Amr bin aas r.a. ko lashkar tayyar karne ka hukm diya, toh woh udhaar me ek oont ke badle do oont khareedte the [Sunan Abu Dawud, 3357], fir yeh muamla Allah subhana wa tala is farman me bhi dakhil hota hai:

'Aye eemaan walo! Jab tum aapas mein miyaad muqarrar tak ke liye karz ka len-den karo toh use likh liya karo (al-baqarah, 28).

Aur yeh muamla bhi jaiz qarzo me se hai aur is ayat mein dakhil hai aur yeh bay’ al-salam (forward buying ) ke tarah hi hai.” [khtam.]

Kya Banks Ka Sood Gareebo Ko Dena Jayz Hai ?


Kya hamare liye jaiz hai ki Banko ka sood kisi mohtaaj aur zarurtmand shakhs ko de-den ?

Alhamdulillah..

Agar to koi aisa shakhs hai jo soodi lain-den karta tha aur ab Tauba karne ke baad sood ke zarye haasil karda maal se chutkara haasil karna chahta hai to is se chutkara haasil karne ke liye kisi Gareeb ko diya ja sakta hai, aur isi tarha agar bank ne is ke account mein sood ki kuch raqam rakh di ho to use bhi Gareeb ko de dein, Lekin yeh sadaqa shumaar nahi ho ga, kyuki Allah subhana wa tala pakiza hai aur pakiza cheez hi qubool farmata hai.

Lekin soodi lain-den karte rahna jaiz nahi balke ye kabira gunah hai, aur sood lene wala Allah ta'la aur us ke Rasool ﷺ ka dushman hai, hatta ke agar woh Gareeb ko dene ke liye bhi sood leta ho.

Allah Uski Dua Kaise Qubul Kare


Dua ki qubuliyat ki shart maise ye bhi hai ki ek banda halal zarye ne kamaye. Par ham maise aksar log sood aur digar haraam zarye se rozi hasil karte hai. Aur fir shikayat karte hai ki Allah hamari dua kyu nahi qubul farmata.

Haraam Kamayi Hui Daulat Se Dawat Dene Wale ki Dawat Qubul Karna

Kya Haraam zarye se kamai hui Daulat wa maal se dawat dene wale ki dawat ko qubul kar liya jaye ya nahi? Islamic shariah ka kya hukm hai is muamle me?

  Jawab  

۩ Shaykh ibn Uthaymeen r.h. farmate hai:

“Kuch ulema ne kaha ki agar kisi shaks ki daulat haraam ho kyuki use haraam tarah se kamaya gaya ho, to us ka Gunah sirf us par hai jo kamata ho, us ki Dawat halal tarah se qubool karne wale par uska gunah nahi.

Ye un Daulat ke tarha nahi hai jo haraam ho khud me hi jese sharab, zabarzasti maal hadap karna aur usi tarha. Is raae ki bunyad mazbut hai kyuki Rasoolullah ﷺ Yahudi ke yaha se apne ayaal ke liye khana laate aur Yahudi aurat ka Khaibar me diya hua Dumbe ko khaye tha (Sahih al Bukhari, hadith-2617.),

aur Rasoolullah ﷺ Yahud ki dawat ko qubul kiya karte the, jab ki ye ache se pata hai ki aksar Yahud sood aur haraam maal ko khate hai (Qur'an,4:161). Shayad Rasoolullah ﷺ ke Ye Alfaaz is baat ki Tayeed me wazeh hai jo Bareerah r.a. ko diya gaya bataur sadqa, Ye Us k liye Sadqa hai aur us ke taraf se humare liye Hadiya hai (Sahih al-Bukhari 5430).”

۩ Shaykh ibn Uthaymeen aur wazahat se farmate hai:

“Jaha tak ke haraam ka muamla hai kyuki ye (haraam) tarike se kamaai gai hai jaise ki kisi ko dhoka dekar, ya sood ke zarye se ya jhut ke zarye se ya isi tarha, ye un ke liye haraam hai jo is tarha se (kamaai kar ke) hasil karta hai lekin ye kisi aur ke liye haraam nahi hai agar wo usse halal zarye se hasil kare. Ye is baat ki zahir hai ki Rasoolullah ﷺ Yahudiyo se karobar(deal) kiya karte the [al-Bukhaari (2165) and Muslim (1551)] jab ki wo haraam daulat aur sood khaya karte the. Ye baat zahir karti hai ki ye hasil karne ke alawa kisi aur ke liye haraam nahi hai.”

Sood Ki Hurmat


Sood ko arbi zuban me 'Ribah' kahte hai jiska lughwi maana(meaning) zyada hona, parwaan chadhna aur buland ki taraf jaana. Aur sharai istelah me ribah(sood) ki taareef ye hai ke kisi ko is shart ke sath raqam udhaar dena ke wapisi ke waqt wo kuch raqam zyada leega. Masalan kisi ko saal ya 6 mahine ke liye 100 rupya qarz de to usse ye shart karli ke wo 100 rupye ke 120 rupee lega, mohlat ke ewaz ye jo 20 rupee zyada liye gaye hai ye sood hai.

۞ SOOD KI HURMAT

ALLAH TA'ALA KA FARMAAN HAI, "Aye imaan walo Allah se daroo aur jo sood logo ke paas baqi rah gaya hai agar imaan wale hai to use chor do, agar tumne aisa nahi kiya to Allah aur uske Rasool ki taraf se jang ke liye khabardaar hojao.

al Baqara:275.

FARMAAN E BAARI HAI, "Aye imaan walon! Kayi guna badha kar sood na khaao, aur Allah se darte raho taaki tum falah paao aur us aag se daroo jo kafir ke liye tayyar ki gayi hai aur Allah aur Rasool ﷺ ki ita'at karo taaki tum par raham kia jaye.

Hajjatul widaa ke mauqe par, jisme taqreeban saare sahaba e kiraam the, isme bhi qhususiyat ke saath aapne tijarty aur mubajani har tarah ke sood ki hurmat ka aelaan farmaya, "Sun lo! Jahiliyat ki har cheez mere paao talee rondh di gayi, aur jahiliyat ka sood khatam kardiya gaya, aur hamare sood me se pehla sood jise mai qhatm kar raha
hoon wo Abbas bin Abdul Muttalib ka sood hai, ab ye saara sood qhatm hai.

Sunan Abi Dawud: 3334, Sahih.

Hazrat Abdullah bin Hinzala r.a kehte hai ke Rasool ﷺ ne farmata:sood ka ek dirham jise insaan jante bujhte khata hai,wo 36 martaba zina kaari se bhi bad'tar hai.

Narrated by Ahmad and al-Tabaraani; classed as saheeh by al-Albaani in Saheeh al-Jaami’ no. 3375.

Jabir r.a. kahte hai : Rasool ﷺ ne sood khane wale, aur use khilane wale, aur uske likhne wale, aur uski gawahi dene walo par laanat bheji hai, aur fir farmaya ke ye tamaam ke tamaam gunah me barabar ke shareek hai.

Sahih Muslim: 895.

Abdullah bin Abbas kahte hai ke Rasool ﷺ ne farmaya, "Jis gaaon me zina aur sood riwaaj paa gaya, to waha ke bashindon ne apne upar Allah ke azaab ko halaal karliya

al mustadrak al hakim.

۞ SOOD BADHTA NAHI GHAT'TA HAI

Sood ko badhta aur parwaan chadhta samjhna, sood ki khaam Khiyali hai, jab ke Allah ta'al aur uske Rasool Muhammad ﷺ ne iske kam hone aur tabah wa barbaad hone ki peshan goyi farmayi hai.

JAISA KE IRSHAAD E RABBANI HAI: Allah sood ko ghatataa hai aur sadaqaat ko badhata hai aur Allah kisi nashukre(sood khor) gunahgaar dost nahi rakhta hai beshak jo log imaan laye hai aur amal e saleh kiye aur namaaz qayem ki,aur zakaat ada ki inka ajr inke rab ke paas sabit hai, aur in par na khauf taari hogi aur na inhe koi gam layeq hoga.
al Baqara:276-277.

(محَقُ اﷲُ الرِّبَامحق) Yam haqullahur ribaa ki tafseer karte hue Abdullah bin Abbas farmate hai: (”محق“) (ghatana) ye hai ke Allah sood qhoor bande ka na haj qabool karta hai, na sadqa, na jihaad, aur na silah rehmi (ya'ani iski koi neeki qabool nahi hoty).

Tafseer qurtubi: 2/232.

Ibn  Masood se marwi hai ke Rasool ﷺ ne farmaya: Jo shaks sood me boht zyada mubtila hota hai, uska anjaam kami par hi hoga.

Sunan Ibn Majah: Vol. 3, Book 12, Hadith 2279, Sahih (Darussalam).

Dunya daar Insaan sood ko nafa baqsh aur zakaat ko maal me kami karne wala samjhta hai, jabke haqeeqat bilkul bar'aks hai, aise qam qhiyaal afraad ki hidayat ke liye sood ke muqable me Allah ne zakaat ka nizam pesh karte hue farmaya, Ke maal ko badhana ho to ise rab ki baargaah me zakaat aur sadqaat ki shakal me peesh karo aur agar tum log jo sood dete ho,taake logo ke amwaal me izafa ho jaye to wo Allah ke nazdeek nahi badhta aur tum log jo zakaat dete ho Allah ki raza hasil karne ke liye aise hy loog ise kayi gunaa badhane wale hai.

۞ SOOD KHANE WALON KI HALAT ZAAR:

QIYAMAT KE DIN SOOD QQHOOR EK QAAS KAIFIYAT ME DOCHAAR HONGE,
JIS SE LOGO KO PATA CHAL JAYEGA KE YE DUNYA ME SOOD KHATE THE, IRSHAAD E BARI HAI :

"Jo Log Sood Khaate hai, Qayamat ke din Apni Apni Qabron se us shaks ki tarah uthenge jaise shaitaan ne Lipat kar Makhboot al Hawas Bana diya ho."
